Uma das altera\u00e7\u00f5es mais pol\u00eamicas \u00e9 a possibilidade de atualiza\u00e7\u00e3o da planta gen\u00e9rica de valores (PGV) pelo Poder Executivo, desde que uma lei municipal estabele\u00e7a os crit\u00e9rios para essa atualiza\u00e7\u00e3o. Essa mudan\u00e7a impacta diretamente o c\u00e1lculo do IPTU, superando jurisprud\u00eancias anteriores que limitavam os ajustes a \u00edndices oficiais de corre\u00e7\u00e3o monet\u00e1ria.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">O Que Diz a Nova Regra<\/h3>\n\n\n\n<p>A nova reda\u00e7\u00e3o do artigo 156, \u00a71\u00ba, III, da Constitui\u00e7\u00e3o Federal, incluiu a possibilidade de atualiza\u00e7\u00e3o da base de c\u00e1lculo do IPTU pelo Poder Executivo:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;Art. 156. Compete aos Munic\u00edpios instituir impostos sobre:<\/p>\n\n\n\n<p>III \u2013 ter sua base de c\u00e1lculo atualizada pelo Poder Executivo, conforme crit\u00e9rios estabelecidos em lei municipal.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p>Essa regra n\u00e3o viola o princ\u00edpio da legalidade, j\u00e1 que a atualiza\u00e7\u00e3o depende de uma lei pr\u00e9via que defina os crit\u00e9rios a serem utilizados. A grande novidade \u00e9 que, al\u00e9m da corre\u00e7\u00e3o monet\u00e1ria, a atualiza\u00e7\u00e3o pode levar em conta o valor real do im\u00f3vel, com base em \u00edndices de mercado.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Supera\u00e7\u00e3o da Jurisprud\u00eancia Anterior<\/h3>\n\n\n\n<p>Antes da reforma, o STF e o STJ restringiam a atualiza\u00e7\u00e3o do IPTU a \u00edndices oficiais de corre\u00e7\u00e3o monet\u00e1ria. O RE 648.245 e a S\u00famula 160 do STJ estabeleciam que qualquer majora\u00e7\u00e3o deveria ser feita por lei formal. A EC 132\/2023, contudo, superou esses precedentes ao permitir que a atualiza\u00e7\u00e3o fosse baseada no valor de mercado, desde que prevista em lei municipal.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u00cdndices para Atualiza\u00e7\u00e3o<\/h3>\n\n\n\n<p>Um dos principais desafios ser\u00e1 a escolha dos \u00edndices de mercado. O \u00edndice Fipezap surge como uma op\u00e7\u00e3o confi\u00e1vel, pois reflete a valoriza\u00e7\u00e3o imobili\u00e1ria das capitais e \u00e9 amplamente aceito. Contudo, h\u00e1 cr\u00edticas de que ele pode n\u00e3o refletir com precis\u00e3o a realidade de regi\u00f5es fora dos grandes centros urbanos.<\/p>\n\n\n\n<p>Outros \u00edndices, como VAR, IGP-M, IPCA e IPCA-E, possuem limita\u00e7\u00f5es para essa finalidade:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>VAR (FGV):<\/strong> Baseado em alugu\u00e9is, pode variar de forma desproporcional ao valor real dos im\u00f3veis.<\/li>\n\n\n\n<li><strong>IGP-M:<\/strong> Influenciado pelo d\u00f3lar, n\u00e3o reflete diretamente o mercado imobili\u00e1rio.<\/li>\n\n\n\n<li><strong>IPCA\/IPCA-E:<\/strong> \u00cdndices inflacion\u00e1rios que n\u00e3o consideram a valoriza\u00e7\u00e3o espec\u00edfica dos im\u00f3veis.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p>O mais relevante \u00e9 que a atualiza\u00e7\u00e3o deve utilizar crit\u00e9rios de mercado, eliminando a fic\u00e7\u00e3o dos valores venais e aproximando a tributa\u00e7\u00e3o da realidade econ\u00f4mica.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Impactos da Reforma no Sistema Tribut\u00e1rio<\/h3>\n\n\n\n<p>A Reforma Tribut\u00e1ria tamb\u00e9m introduziu medidas para combater a regressividade, prevendo maior tributa\u00e7\u00e3o sobre impostos pessoais e reais e redu\u00e7\u00e3o dos tributos sobre o consumo. O artigo 145, \u00a7\u00a73\u00ba e 4\u00ba, refor\u00e7a os princ\u00edpios de justi\u00e7a tribut\u00e1ria e transpar\u00eancia, buscando uma distribui\u00e7\u00e3o mais equitativa da carga tribut\u00e1ria.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Considera\u00e7\u00f5es Finais<\/h3>\n\n\n\n<p>A possibilidade de atualizar a planta gen\u00e9rica de valores com base em \u00edndices de mercado representa um avan\u00e7o para a justi\u00e7a tribut\u00e1ria, mas exige cuidado na implementa\u00e7\u00e3o.
